LEGAL FRAMEWORK:
Executive Orders Guiding BPA Activities Affecting Columbia River Basin Fish
& Wildlife
Executive orders are official documents through which the President of the
United States manages operations of the Federal Government. BPA actions to
protect, mitigate, enhance, and recover fish and wildlife in the Columbia River
Basin are guided by the following Executive Orders:

Consultation and Coordination with Indian Tribal Governments

E.O. 13175 (Nov. 6, 2000) |
Requires executive agencies to respect Indian tribal self governance and
sovereignty, honor tribal treaty and other rights, and strive to meet the
responsibilities that arise from the unique legal relationship between the
federal government and tribal governments. Each agency shall have an
accountable process to ensure meaningful and timely tribal input in the
development of regulatory policies that have tribal implications.

Government to Government Relations with Native American Tribal Governments

Memorandum for the Heads of Executive Departments and Agencies (April 29, 1994) |
Requires, among other things, that executive agencies operate within a
government-to-government relationship with federally recognized tribal
governments; consult to the greatest extent possible with tribal governments
before taking actions that affect tribal governments; and agencies assess the
impact of federal government plans, projects, programs, and activities on
tribal trust resources and ensure that tribal rights and concerns are
considered in developing them.

Regulatory Planning and Review
|
E.O. 12866 (September 30, 1993) |
Establishes a program to reform and make more efficient the regulatory process,
including making the process more accessible and open to the public. Wherever
feasible, agencies are required to seek the views of appropriate state, local
and tribal officials before imposing regulatory requirements that might
significantly or uniquely affect them.

Enhancing the Intergovernmental Partnership
|
E.O. 12875 (October 26, 1993) |
Prohibits executive agencies, to the extent feasible, from promulgating any
regulation not required by statute that creates a mandate upon a state, local,
or tribal government, unless funds necessary for direct costs of the mandate
are provided by the federal government or the agency has consulted with
affected state, local, or tribal government. Requires agencies to develop
effective processes to permit state, local, and tribal representatives to
provide meaningful and timely input in the development of regulatory proposals
containing significant unfunded mandates.
