  Pisces Application - End User License Agreement

IMPORTANT--PLEASE REVIEW AND AGREE TO THE TERMS OF THIS SOFTWARE END USER LICENSE AGREEMENT BEFORE USING THE PISCES CLIENT COMPUTER SOFTWARE. 

BY CLICKING THE “ACCEPT” BUTTON BELOW, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT.  IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE AGREEMENT, PROMPTLY EXIT THIS PAGE WITHOUT USING THE PISCES CLIENT COMPUTER SOFTWARE.

PISCES CLIENT SOFTWARE END USER LICENSE AGREEMENT

Use of this Computer Software (the term “Computer Software” means the PISCES CLIENT software and any other accompanying documentation) is governed by the terms of this end user license agreement ("License Agreement").  The term “You” includes the user and the user’s employees, agents, representatives, and contractors.

You may not use the Computer Software unless You first agree to this License Agreement.  By using this Computer Software, You have agreed to be bound by the terms of this License Agreement. 

 Under this License Agreement, the Bonneville Power Administration (“BPA”) hereby grants to You a personal, nonexclusive, and nontransferable license to use the Computer Software only in accordance with these terms and conditions, and for no other purpose.  Any publication, reproduction or distribution of the Computer Software not in accordance with this License Agreement is expressly prohibited.  Without limiting the foregoing, copying or reproduction of the Computer Software to any other server or location for further reproduction or redistribution not in accordance with this License Agreement is expressly prohibited.

 In addition to any and all other rights not granted to You expressly in this License Agreement, You do not have the right to:  (1) distribute or license any copy of the Computer Software to third parties, (2) conduct workshops or otherwise make presentations or public performances on the use or any aspect of the Computer Software, or (3) make derivatives or other versions of the Computer Software.  Any rights not expressly granted herein are reserved to BPA.

THE INFORMATION INCLUDED IN THIS COMPUTER SOFTWARE IS PROVIDED WITHOUT CHARGE AS A USER CONVENIENCE AND IS TO BE USED FOR INFORMATIONAL PURPOSES ONLY.  THIS COMPUTER SOFTWARE IS PROVIDED  “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.  IN NO EVENT SHALL BPA OR ITS AGENTS, CONTRACTORS, OR REPRESENTATIVES BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS COMPUTER SOFTWARE.

The information included in this Computer Software is provided without charge as a user convenience and is to be used for informational purposes only.  While BPA has attempted to provide accurate and timely information, any application or information may include inadvertent technical or factual inaccuracies.  BPA reserves the right to make changes or corrections at any time, without notice. 

 You acknowledge that the Computer Software is subject to applicable export control laws and regulations of the United States.  You agree not to export or re-export the Computer Software, directly or indirectly, to any countries that are subject to United States export restrictions.

 You acknowledge that no joint venture, partnership, employment, or agency relationship exists between You and BPA.

 This License Agreement does not include any technical support services from BPA.  Limited technical support for the Computer Software may be obtained from BPA on a case-by-case basis and upon payment of any applicable fees.
