Lease Land
Land Acquisition / Conservation Easement | 92
|
Definition
Includes riparian, grazing, and multiple-use leases, typically for multiple years.
Deliverables (recommended)
- Lease of the land to include the lease agreement document
Rules and Examples (work element scenarios and associated rules)
Rule 1: Any ESA, NEPA, permitting, or other environmental compliance work should be split out under WE# 165, Produce Environmental Compliance Documentation. Also, operations and maintenance (O&M) costs should be split out WE# 22, Maintain Vegetation.
Example:
WE: Lease Land
WE Title: Lease riparian area on Trout Creek
WE Description: Complete lease agreement with landowner on a 3 mile reach containing 50 acres of riparian area on Trout Creek for 25 years
WE: Produce Environmental Compliance Documentation
WE Title: Provide BPA with NEPA checklist for Trout Creek lease agreement
Rule 2: If you are leasing land at various locations, a work element must be created for each location to document metric requirements.
Example:
WE: Lease Land
WE Title: Lease riparian area on Trout Creek
WE Description: Complete lease agreement with landowner on a 3 mile reach containing 50 acres of riparian area on Trout Creek for 25 years
WE: Lease Land
WE Title: Lease riparian area on Salmon Creek
WE Description: Complete lease agreement with landowner on a 1.5 mile reach containing 30 acres of riparian area on Salmon Creek for 30 years
Rule 3: You only need to split associated work elements if lumping would hide the work associated with a certain metric, e.g., if you are leasing land and installing riparian fence, you cannot lump it under lease land because they both have metric reporting requirements. If one of the associated actions does not have metric reporting requirements it is possible to lump them.
Example (splitting):
WE: Lease Land
WE Title: Lease riparian area on Trout Creek
WE Description: Complete lease agreement with landowner on a 3 mile reach containing 50 acres of riparian area on Trout Creek for 25 years
WE: Install Fence
WE Title: Install 6 miles of fencing on 3 mile reach of Trout Creek riparian area to exclude livestock.
Milestones (may include)
- Environmental compliance requirements complete
On-the-ground work associated with this work element cannot proceed until this milestone is complete. Milestone is complete when final documentation is received from BPA environmental compliance staff (completion can be based on pre-existing environmental documentation from BPA).
- Planning and prioritizing sites to be leased
- Negotiating with landowners to reach lease agreement
- Produce Management Plan
- Appraisal of value if landowner to receive lease payment
- Surveying or demarcating the boundaries of the leased parcel by fencing or other methods
- Searching public records for encumbrances on the land to be leased
- Recording the lease as an encumbrance on the property
- Monitoring compliance with the lease
- Enhancing the parcel
- Operating and maintaining the parcel
- Attach a completed water survey form in Pisces
The water survey form is located at: http://www.efw.bpa.gov/IntegratedFWP/WaterSurveyForm.doc. The form should be completed by the contract manager or BPA project manager and attached in Pisces.

# of riparian miles protected |
Add length on both sides when both sides are protected. Add one side when one side is protected. Normally, riparian habitat protection is intended for the benefit of fish. |

# of riparian acres protected |
# of acres applies to both wildlife and fish habitat land transactions. Riparian is defined as above the ordinary high water mark of the stream and within the flood plain of streams. To determine total acres purchased, we will sum the upland and riparian acreage. |

This metric only applies to acquisitions in riparian areas. Must be entered in decimal degrees. For help converting from degrees, minutes, seconds go to http://www.fcc.gov/mb/audio/bickel/DDDMMSS-decimal.html. |

# of upland acres protected |
# of acres applies to both wildlife and fish habitat land transactions. Upland is defined as above the elevation of the riparian zone (above the floodplain). To determine total acres purchased, we will sum the upland and riparian acreage. |

# of wetland acres protected |
# of acres applies to both wildlife and fish habitat land transactions. Wetland is defined as meeting the federal standard for wetland delineation under the Clean Water Act. Because wetlands can be located either in riparian or upland areas, the acres you claim here should overlap with the acres you claim as upland and/or riparian. To determine total acres purchased, we will sum the upland and riparian acreage. |
