Definition
Covers any work by the Contractor to assemble, gather, acquire, or prepare documents in support of obtaining environmental compliance from BPA, providing maps, drafting a Biological Assessment, obtaining permits, conducting public involvement activities, completing an archaeological survey, etc.). In all cases, environmental compliance work done by the Contractor must be separated from all other work. It is not permitted to combine environmental compliance activities with any other work element.
Deliverables (recommended)
- Documentation and assistance to support BPA's Environmental Compliance Group (such as maps, design drawings, survey reports, permit applications, ESA documents, etc.). Will vary based on the type of activity.
Rules and Examples (work element scenarios and associated rules)
Rule 1: This work element only covers work by the Contractor to assemble, gather, acquire, or prepare documents in support of obtaining environmental compliance from BPA or directly from regulating agencies. Any work completed or managed by BPA's Environmental Compliance Group should not be added into the contractor's SOW.
Example:
WE: Produce Environmental Compliance Documentation
WE Title: ESA compliance for project work for culvert installation
WE Description: Draft a Biological Assessment for culvert installation activities and submit it to BPA's Environmental Compliance Lead.
Rule 2: If the statement of work covers many work elements that require environmental compliance, you may lump all the Contractor's environmental compliance work under a single work element. However, you may wish to break the work up into separate work elements if it provides clarity or better supports project management. Project managers may also choose to split out significant actions such as a cultural resource survey as a separate work element. BPA's Environmental Compliance Lead can provide guidance.
Example: The Contractor is proposing to do some data collection and then use that information to design and install a weir. The Contractor has the following work elements on their statement of work: Collect/Generate Field and Lab Data, Produce Design and/or Specifications.
Option 1 (lumping)
WE: Produce Environmental Compliance Documentation
WE Title: Environmental compliance for data collection and weir installation
WE Description: Provide BPA Environmental Compliance Lead with information to support ESA, cultural resources, and public involvement compliance. [Note: All of the Contractor's time and expenses related to obtaining environmental compliance from BPA will be covered under a single work element.]
Option 2 (splitting)
WE: Produce Environmental Compliance Documentation
WE Title: Environmental compliance for data collection activities
WE Description: Provide BPA Environmental Compliance Lead with applicable copies of all (NMFS and USFWS) permits related to data collection activities.
WE: Produce Environmental Compliance Documentation
WE Title: Environmental compliance for weir installation
WE Description: Draft a biological assessment for weir installation activities and provide to BPA's Environmental Compliance Lead. Provide EC Lead with a detailed map and project description for cultural resources compliance. [Note: The Contractor's time and expenses related to obtaining environmental compliance from BPA will be separated under these two work elements.]
Rule 3: Environmental compliance activities always require their own work element - WE #165, Produce Environmental Compliance Documentation - so that BPA can track environmental compliance costs across the Fish and Wildlife Program. Completion of Environmental Compliance Requirements should also be listed as a milestone under any work element that has an environmental compliance requirement.

WE Title: ESA and cultural resources compliance for project work for culvert #1 installation
WE Description: Draft a Biological Assessment for culvert installation activities and submit it to BPA's Environmental Compliance Lead.
Milestones:
- Contact BPA's Environmental Compliance Lead to determine what documentation and assistance will be needed
- Complete and submit map and detailed project description for cultural resources consultation.
- Complete and submit Biological Assessment
- Obtain sign-off from BPA's Environmental Compliance Lead that environmental compliance requirements are complete
WE: Install Fish Passage Structure
WE Title: Replace Culvert #1
WE Description: Install a pipe-arch culvert designed for 100-year event at Houghton Creek RM 21.
Milestones:
- Hold initial kick-off meeting with all stakeholders
- Environmental compliance requirements complete
- Mobilize crew
- Supplies/materials/equipment delivered
- Instream work complete
- Revegetation complete
- Punch-list inspection items complete
Milestones (may include)
- Determine what documentation/assistance is needed from BPA's Environmental Compliance Lead
- Assist BPA's Environmental Compliance Lead to meet necessary environmental compliance requirements
- Complete and document public involvement activities
- Participate in ESA Consultation (may include drafting BA, completing HIP BO Consistency Form, etc.)
- Participate in Cultural/Historic Resource Consultation
Examples include providing maps, and detailed project descriptions, contracting for an archaeological survey, etc.
- Obtain/Renew applicable local, state, federal and tribal permits
- Complete Land Audit
- Obtain BPA's Environmental Compliance (EC) Lead sign-off that EC requirements are complete
- Submit monitoring/reporting related to environmental compliance as required by permitting agencies
Examples include HIP II BO herbicide reporting, cultural resource monitoring, NPDES monitoring and reporting, water use reporting, etc.
- Provide BPA EC Lead with calendar year XXXX proposed herbicide use
Contractor submits any proposed herbicide use on an approved form to the BPA Environmental Compliance Lead
- Provide BPA EC Lead with calendar year XXXX actual herbicide use
Contractor submits any actual herbicide use on an approved form to the BPA Environmental Compliance Lead

Applicability and status of the following environmental compliance requirements can be found on the Environmental Compliance tab for that work element in your SOW for all 2007 contracts forward. BPA's Environmental staff will update and maintain this information in Pisces in real time, so that you can check the status of environmental compliance on your project at any time. Note: Many of the fields are set to auto-load in Pisces, but the settings will be reviewed by BPA's Environmental staff prior to the contract being finalized, and may be revised depending on the specific circumstances.
